i must apologise for putting my last note on the Agost site,thats what tiredness does to the human brain.What the Town Hall has to impress on bar owners by way of written notification is the EU laws to which Spain signed up to also,and the consequences to the whole community by the way of huge fines levied at the Ayuntamiento for not enforcing those laws.These fines are paid for from money you and i pay in rates etc.Take away money from the public coffers results in the withdrawl of services from some other area. The late night licences which the last council handed out to several bars are an infringement of Section 3D of the noise act 37/2003.This law governs only bars and industrial premises which states that "any noise created within said premises must be contained within and be fitted with two sets of doors in addition to soundproofing.Everyone has a right to respect for his private and family life,his home and his correspondence".The situation in La Marina is caused by a failure of the local authorities to take appropriate action to put a stop to third party breaches of the right relied upon by the complainant.The granting of 4.0 a.m closure licences was misconstrued by bar owners as being a licence to make noise until that hour.This brings me back to the question ,have the bar owners ever had sight of the EU laws when signing up for their aperturer?I think not.It,s only a matter of time before the proverbial hits the fan and then watch out.Try reading the Moreno Law on Noise Pollution brought on to the statute books by none other than  a Spanish lady in Valencia who took the Town Hall to the Court of Human Rights in Strasburg having suffered for 8 years from noisy bars around her and being ignored by the Ayuntamiento.Makes good late night reading.I rest my case your honours.
