Non Residence Tax

Friend of mine just sold his house in La Marina,he has been here as a non Resident for 9 years and never paid the non residence tax, his solicitor paid 3000 euros from the sale of the house to the Notary,this goes to the Spanish Government to pay for the tax , the rest of the 3000 euros is a fine, he has been told by his solicitor if he appeals the government will increase the size of the fine, he accepts he should have paid the tax,,,but never received a demand or invoice... but it seems the Spanish government make up the size of the fine,,don't forget if you are a non resident,,pay your non resident tax each year,

It is what it says on the tin Robert. A tax for anybody with a holiday home in Spain, who is a non-resident.
It is paid yearly to the Spanish Hacienda, to make up for the tax that Spain supposedly loses, when people rent out their holiday homes for parts of the year and don't declare the rental income for tax purposes.
In an easy way to explain, The people who have a holiday home in Spain and use it for part of the year, and leave it vacant for the rest, pay tax so that many people who have holiday homes, can rent it out and earn income which they don't pay any or enough tax on, can have a good laugh about it.

applies to everyone who is a non resident and has a home in Spain regardless of weather they rent out there home or not, my friend never let out his holiday home in 9 years but was still collered for 3000 euros by the solicitor and notary at the sale.

As a non resident you should have a fiscal representative and as such they should be submitting to Hacienda each year. Your fiscal rep does not need to be a lawyer or notary etc but must be resident in Spain . I believe it's a legal requirement for all non residents " i could be wrong"

We bought a house last year and I am confuse as well regarding these "none resident" taxes. My bank "CatalunyaCaixa" take some none resident fee from my account as well. Do you have these fee from your bank too?

No, not your bank, this is a tax you need to pay yourself, you could ask your solicitor to do for you annually, or some use a local lawyer or legal rep/agent,or as weejohnten mentions a fiscal representative ,,they should not charge very much for this just make sure they are paying your NON residence tax to the government and not pocketing your money,,the problem arises if you ever sell your house and the tax has not been paid. It is definitely a legal requirement to pay non residence tax

I have just spoken to my solicitor who I used to buy our property,and who I have kept on a yearly retainer to look after all such problems and she has confirmed that I have paid my NON residents tax each year, she files an annual NON residents tax return on my behalf. So legal again till next time.
