LETS ALL COUNT TO TEN AND START AGAIN

ASL Member Founding Member Bericht #16459 Reacties gesloten

Having read all posts to do with the Bar noise Let us all stop and rethink exactly what has been said.
It appears that most Bars do not have appropriate Licenses, most have some sort of entertainment, mainly because that is what the vaste majority of residents and holiday makers want, the Bars say the cost of Licenses and alterations to their property is prohibitive, why are License costs so expensive,I gather the License money goes to the Local Council, why dont the local council just charge what it costs to issue plus a small percentage on top, after all the fact the places are open and taking money surely can only be good for the area. Why are the costs of alterations so expensive,Do we really need all these alterations, are they really necessary,Less license fee and less alterations, equals less expense for bar owners, could easily mean more licenses applied for if the cost is realistic. In return all those Bars with a license must stop live music(i,e no mics or speakers)at a set time which must be strictly adhered to)possibly midnight or a little earlier seems to be the time most residents are happy with. All Bar Owners to monitor outside area for decibel level throughout the night.that is up to the council to set a realistic level.Any resident who lives close to a bar and who thinks the noise is too loud, would be allowed to go to the Bar and insist on a decibel check, which should be done immediately with the complainent present,if a bar owner refuses they should be reported to the police immediately(that should make sure the Bar owner complies with request)The bar owner to be responsible for unruly people leaving his bar late at night,if people are creating a disturbance the Bar owner should call the police for assistance.
Bars with a late license(allthree of them) to be responsible to adhere to current entertainment license requirements, albeit at a lower licence rate than they are at the moment, which are vastly inflated.but as most trouble seems to be around the 3am period,if possible a police presence should be present if possible.
The Council shoould make the bar owners aware on a monthly bases of complaints made and to which bars they are made against,If the same bars are having many complaints then the music license should be revoked for a set amount of time.
The Councillors and the the Mayor, should stop squabbling amonst themselves, and help people to live and let live.
This would not be a conrete list set in stone, but could be adjusted at some time.
I dont know if this would work or even be allowed to work, what i do know is if it carries on as it is now, someone at sometime is going to get hurt, because of the anger being shown all around us

Everything you have said makes complete sense Alan.... I just don't get why the council are being so quiet. I even went on the EU website to see if there is anyway residents of a town can appeal or get rid of a council or sort something in the way that the bars can play live music.

From what I can see only half the Truth is being told or spoken about. I think and I am open to correction that it is all down to a law passed by Valencia a few years ago.
This stated that all places of entertainment had firstly to have a License.

Secondly had to be soundproofed, Thirdly Music of all description was not to be heard at any time outside the said premises. Outside music could be practiced if a license was applied for by the said venue or organizer.
This meant the end to what Spain and the Tourists had always been used to. So it seems that the Spanish did what they often do ignored it and local councils carried on as if had never been passed as they recognized that if fully implemented it would ruin the local area.
This it seems has muddled along quite well until a small handful of locals who never want to hear Spain’s lively side started to complain direct to Valencia itself. Now what is happening is that behind the scenes it is being realized that this very unworkable ruling from a few years ago might have to be implemented fully. Which if carried out will have a knock on effect and take away from all areas of Valencia what Tourists expect.
As I see it this is not something that local councilors can't change at all. It needs the Law to be amended sensible at a higher level. So councilors should start to LOBBY the powers that be to do just that and quickly, ie Valencia needs to make changes to this Law.

Ian
If that is correct I can't see them wanting to admit to it one way or the other.

Find it hard to believe that if that was the case, why has this problem only seemed to of happened in LaMarina,Last year that was what our Council were told by Valencia, but almost every place i go to i hear music coming out of bars,so what does that tell me.but dont forget even jeff told us a few months ago licences are issued by the Council at a fare set by them

ASL Member Founding Member 2012-11-07

All I now know is that on Jeff's blog he has told them to get the correct licence. We know that will never happen in a million years. So f nothing is resolved bars will start closing at a slow rate. Then everyone will turn against the PP and Jeff and his assistants. So good luck in the next election.

Alan
About four years ago they did the same thing to Quesada. All music was stopped but slowly it has come back as if nothing happened. That all were told at the time was down to the Valencian ruling. The thing is to make proper changes to this law it would be a major task.

If you read deeper into Ian's posting it sounds like Valencia did indeed ban all outside music. If that is the case it know wonder it is not being observed.

At last common sense this would make all the bars etc legal and able to run as they should and put the moaners in there place BUT I think there will still be some that WOULD not want to abide by that those are the ones that need to targeted and sorted out for this to work!

its all good saying that but it will cost bars thousands to do what needs to be done there must be 50 plus bars on this urb and only 3 of them have correct papers.
My guess is this will soon die down and then bars can get back to doing what they do but this time keep the noise down and finish at a respectable time. The problem is between now and then how many bars will make it through this.

ASL Member Founding Member 2012-11-07

well said Ian, without any music La Marina would hardly attract any visitors.
I believe bars are playing music without the apporpriate licences so the law wants implimenting to educate them they need on.
I realize this costs money, but then so does everything.

Very well said what needs to be done needs to be done its what I have been trying to point out all along but some just dont want to do this !! and want to bang on how hard it is to run a legal bar!!

ASL Member Founding Member 2012-11-07

I realize that licences cost money, but it is nouse bars moaning if their music is curtailed if they do not have the appropritate licences.
This is like a person caught driving without a driving licence moaning that they could not afford on, if he cannot afford one then they should not be on the road.

Not quite the same a driving licence costs what it cost the relevant dept. to issue it and pay the wages etc.of them that produce .A music/kareoke licence on average costs so much more than that with the profits going to the Council to do with as they think.
Would you buy something that costs perhaps 30 euros to produce and pay perhaps a thousand euro,I think your answer quite sensibly would be no

ASL Member Founding Member 2012-11-07

Even if they all abide by the law and get there correct Licenses, I think I am correct in saying that Bars will not in the summer months be allowed to have music outside at all. That all by itself is a nonsense. This is the bit that every one is ignoring. Every one has to be inside soundproofed aircon rooms. THAT IS NOT WHAT IS WANTED!! IS IT?

ASL Member Founding Member 2012-11-08

no it is not what we want during the lovely summer evenings, perhaps it might be better if the people who cannot stand noise soundproofed their own homes, let them have the expense of doing so and not the bars

There will never be a compromise all the time every one wants to do as they please and sod the rest as long as they make a few Euros and not adhere to the rules that others do saying its what every one wants

You are a stickler for keeping to the rules where Bars are concerned 2nd casa,I hope you realise just how many people (even Councillors)dont obey the rules,If we lose our Bars, the Council just may take action over the many rules that we the residents ignore, either because we are ignorant of them or choose to believe they dont apply to us.You of course may be one of those chosen people who claim to obey all rules. If so good on you,but i think you are one of the few.

Hola , not at all I have probably broken more rules laws etc than I care to remember but I dont /didn't moan about it if I got caught out just kept my head down and carried on without anyone knowing any the wiser, BUT what I dont/ didn't do was think I was above the law by only being partly legal and then thinking that will be all right then but if caught out I would have to the consequences of my actions

Happy days

PS I seem to find some bars restricting especially those in strange-ways/broad-moor dont you think, did we and some of the others from La Marina meet there at some time !! ?
