The Law - Awnings.....

As I think a lot of you on this forum will know, that I am most certainly anti-smoking in public areas, and we have had quite a few heated debates on this forum about this subject. I do NOT wish to go over all that again, but we haven't covered the The Law & Awnings.................

What I would like to know please are a couple of answers to the following:

1. Am I correct in saying that anyone wishing to smoke are allowed to do this in an awning (which a lot of the bars & restaurants have erected adjacent their main building now the cold weather is here)so long as there is an opening ie part of the awning is left open to let the smoke out?

2. My main question is - Many of the owners of restaurants/Bars are now leaving doors open from their main inside building to the awning. SO, subsequently the smoke is coming in to the main restaurant (where you are not allowed to smoke).

I would like to know if this is within the Spanish Law please? OR should the doors be completely closed in the main restaurant? HENCE - Letting the smokers smoke to their hearts content in the awning area and letting us non-smokers enjoy the evening without having to inhale their smoke?

Dont no if its Spanish law but hope so. Keep the main room and awning room completly seperate. Never smoked discusting habit. Keep the smokers well away is what i say

Smokers are allowed to smoke in awnings as long as 2 of the sides are open assuming the awning has 4 sides,...if there is just the roof part of the awning then there is no law on smoking, as for opening the doors to bars with awnings where there may be people smoking i really don't think there is a law for for this, but just a matter of choice for the proprieter,...but then comes the other issue!! smokers have been sent outside, (i'm a smoker,..but going outside doesn't bother me) the next thing you know the non smokers want to then have smoking stopped in the bars/ cafes awnings,...just because they may fancy sitting outside,...what do they want next? smokers to pay for air tax? I remember when the ban came in in the UK,...all the non smokers went outside to drink and chat to their friends who were out smoking,...then to top it all off,..a smoking area was constructed for the smokers and in summer the non smokers wanted to take over the area provided for the smokers and then had the audacity to complain about the smoke when just 6ft away was 40 other benches and tables that were provided for everybody's use,...honestly,...you just can't please some people

Carol,If you want to know what Spanish Law is,Then dont ask it on a Local Forum,you will get too many different answers.Just ask the Dept .that is responsible.
p.s Why have you and several other people on this Forum recently changed from in La Marina to in Spain,are you lot becoming embarrased at living in La Marina.I am proud to live here,and will always be `from La Marina`

I was trying not to be arguementative ,about your anti smoking stance,but you would prefer the storyline to run and run,So in the winter you complain about the door into the bar being where the awning is,in the summer it was that smokers actually dare to smoke outside on the terraces,Apart from making smoking illegal,is their anything you would settle for regarding people who dare to enjoy a cigarette,
But i still say if you want to know what the Law is regarding awnings and bar doors,is to find the relevant Dept who deal with these matters and ask them.Of course you do have an alternative,and that is to tell the bar owner,why you will not frequent their establishment,until they change their layout,If you can get lots of other people to do that,you may get the Bar owners to change the way they operate.Ooops sorry didnt think,but that would be against human rights,by cutting back on where you can eat or drink

I do not wish to go over old ground Alan, but to be honest I wouldn't settle for anything other that it being completely banned in public. Enjoy your cigarettes in the privacy of your own home/surrounds and stop inflicting it upon others in public areas.

Do you know what the relevant Department is for these matters Alan? In any case as I do not speak Spanish I doubt that would be any use.

Not everyone who sides with smokers is a smoker.
Unfortunately Carole I do not know the relevent Authority,but I think Googling Spanish health and safety Laws wouls be a good place to start.

As its new year I decided I would have a few bottles of wine and then go for a drive though the town center as fast as I could, just to see how many people I could kill, but when I started to think about it more, and as a grown up I started to understand that this was a foolish thing to do, so I sat down and had a fag instead. Lets think about it, you put something in your mouth light it and then suck the smoke into your body with over 200 different harmful chemicals in it. And you think you are cleaver?

I have no issues with Carol. In fact I have been out in a group with Carol and when I have gone outside to smoke Carol has not passed comment on my habit. My issue was with Daves insulting comments.

Yes Dave smoking is not an intelligent thing to do,and I lay odds that most smokers given the choice would wish they had never tried their first one.But it is not a one way thing,or are you one of those car drivers,who think that the exaust they throw out of the back of cars,are of no danger to your or anybody walking along he road,the chemicals contained in your fuels,contain some carsonogenic agents,so perhaps it is not only smokers who damage there health and the health of others,the only exception is that the majority of smokers realise this where as most car drivers know it but refuse to believe it,

Passive smoking kills others, therefore smokers could be called murderers or charged with manslaughter or GBH. What about the poor old lady who slipped on a Dog End and broke her neck ? or the poor baby that picked up a burning ember and dropped it on his clothes which then caught fire, I could go on and on and on, but then it becomes BORING.....

The difference is that a car is part of life that benefits mankind, smoking is just a killer, I can not understand anyone with a brain smoking,
If you have children do you teach them to smoke or do you tell them its bad for you? If the answer is that you try to teach them too not smoke then you are a fool for doing it yourself

Well Myra if you have no kids then the best thing for you to do is go and stand outside the school and pass out the fags, as you seem to think it's good to get everyone smoking you may as well get the young ones started

At no time have I stated that smoking was good for you. I merely stated that if I choose to smoke it does not make me stupid. I do not force my opinions on others nor do I try to turn non smokers into smokers. I do have one suggestion for you Dave - stick your rude remarks where the sun doesn't shine. People have been smoking for over 450 years so there has been quite a few" stupid" people then. I can understand people not liking cigarette smoke but to tell someone they are stupid for doing so is to say the least - insulting. As long as something does not affect you, why take umbrage. I just try to avoid being in places where it would affect me. Are you a non-drinker as well Dave?

I was in the bar the other night and this bloke was drinking next to me, do you think that I am going to get cancer as a passive drinker, NO but if he was smoking then I could get cancer as a passive smoker.
Why do you think that smoking has been banned in most places and not drinking.
Please could you lit me know what word you would use for a smoker.
Is smoking a sensible thing to do? If no then it must be a stupid thing to do, making those that do it studied its not hard to understand

you can please some of the people some of the time,...but never all at once!! although there seem to be a few people in La Marina, that no matter what was done with regards to smoking and all other things alike they would still find something to moan about,...they just cant help themselves,...i'm pretty sure they just sit at home and rack their brains to think about the next topic to post on this forum to get a rise outta people,...oh by the way i went into a bodega bar the other day down in the village and sat there inside were 2 officers of the gardia,..their car was outside and they were sat there drinking brandy and coffee and smoking inside the building!! now would you go and tell them to go and smoke outside? really don't think you would! the thing is if you go into most small traditional spanish bars they still allow smoking inside the building,...it's just the way things are! why cant people just be happy for a change? you live in spain, you came out here to fulfill you dreams and ambitions,...STOP YOUR BLOODY MOANING!!!...rant over...lol,...time for a fag to calm down

In fact that is not correct, at least two sides of the building have to be open to allow smoking inside (three in the UK). You can not just open a small section of an awning to allow smoking inside, If that was the case a bar could open double doors to allow the smoke out

3 Cars serve mankind and are important.(is it important to drive 100 metres to the shops or drop kids off down the road,or do many of the journeys you make by car that can easily be made by walking or jumping on a bus.No Dave is isnt helping mankind,only in the sense that a load of carcinogenic waste that comes out of cars making unnessary journeys,because people like you have become lazy,and instead of condemning your way of life, you conveniently blame everybody else.Dont tell me that buses use fuel,because i understand that most transport is necessary,but each bus on average takes over 20 cars off the road,
I havnt read yet of one smoker ,declaring they are right to smoke,but that they have a right,most will not smoke near non smokers,but non smokrs have the right to move away,if that doesnt happen.

Myra I gave up smoking 42 years ago. It was very hard but,, fortunately for me I lived in the back of beyond, on a Farm, so I could not get them very easily.
When I did go to the shops I bought myself some mentholyptus sweets and believe me, if you try to smoke after sucking one of these, it tastes vile. But it did the trick. I know it is hard to give up but, think of all the things it does to you.
