Destruction Cert

I am sorry if this posts twice, had a glitch with comp. I live on La Marina, although am in the UK as I lost my husband and had to come back to work and I get out there a couple of times a year and will be back for good next year. I had a car (in my late husbands name) which had sat on my drive for 4 years and I thought it would be ok when I came back, but decided it had seen better days and phoned a guy to come and scrap it, he told me I would get Destruction Cert in 2 weeks, he took the car 17th June, and after constant emails to him he just keeps stalling me, asking for my phone number?? why I dont know even though he has not rung. He also stated it was taking a bit longer as he didnt have my husbands NIE only death cert, not true I gave him copy of my husbands NIE cert, and not only that he wrote his NIE on the reciept he gave me, now I am really worried he is not going to scrap this car and put it back on the road, I really dont want to be liable if this happens, does anyone know what I can do in this situation? I would be grateful for any help, this guy advertises in the local papers every week, how can I get him to give me this certificate.

I suggest you name him.

If you have any of the documents, even copies, for the vehicle I suggest you scan them in and send as much information as you have on the vehicle and the person in question to the local police here in La Marina and let them deal with this on your behalf.

Go down and see Jeff opposite the tourist info centre
They would advise you correctly.

thanks for your replies, I have got the receipt he gave me on headed paper and with words "for scrap" and my husbands nie and the make model and reg number on and have told him that my neighbour will go to the suma office and to the police with copies of all correspondence by email that has taken place, and his reciept - so I will do that, I just wondered if there was anything else I needed to do, but thankyou for all your comments - appreciate it - Lynne

Hi Lynn, If your neighbor does not get any joy, get them to pop in and see me, I can sort it out for you. We are just moving to new premises next to Brina's Furniture shop between Iceland and Mercadona, or give me a call on 649231346. James

Thanks James, I will ask her to come and see you, as she herself is on her own and I feel a bit guilty her having to sort this out for me. Should she take all the info to the police first though? I am just so worried that this car will end up back on the road - and the repercussions that could have on me and not being out there at the moment to sort it out is worrying, but thankyou for your offer of help it has made me feel alot better. Thankyou once again James - Lynne

HI Lynne, To be honest the Police will probably just tell you to go to trafico and "Baja" the car, which we can do for you. Although you sold him the car for scrap, a receipt written in English means nothing in law here so the onus will be on you to sort it out. Give me a call and I will explain it to you in detail.
