Habitacion Certificate

Frizzy,
I was told by a Chairman of an Urbanisation Committee, that the seller does not need a Habitation certificate to sell, it's the buyer who needs to get the Certificate. It's just a con by Estate Agents to get 4 or 5 hundred Euros off you.
As I said, this was told to me by someone 'in the know', whether it's true or not, I don't know, probably best to get Legal advice.

A habintation certifcate is issued when the property is completed by the builder and issued by the town hall it is for life with the property and you need this to sell to show that the property is legal you do not need it renewed

If you had a NIE years ago they done temporary's that ran out but over the past years they are now with you for life they do not run out

EPC start from 125 euros depends on property size

If you have the original Habitation Certificate, or Licence of First Occupation,ie if you were the first owner, you do not need a new one. If you are selling your property, you do need to get a new one, to prove that no new works have been done on the property. You can get one direct from the Town Hall for 50€. The new owners of the property also need to get a new one, so the names on the electricity and water contracts can be changed. Do not pay the exhorbitant charges from estate agents.
The average price for the Energy Certificate is around 120€.

I read with interest the comment that you need a habitation certificate to sell a house.....not true!! I sold my house in El Pinet which has never had a habitation certificate without any trouble at all. I've recently heard that the certificates may be issued in the near future which will please all the people who have had houses there for all these years.

If property does not have habitaction certificate it can be difficult but if you are taking over an existing mortgage or cash buyer you can get the property registration that is in the suma office as i have sold a property like this and they did get there habitation certificate in the end as long as the property was on the property registry it was legal

Frizzy did you go to the Town Hall re the Habitation Certificate? i popped in yesterday but there was about 15 people waiting to be seen so didnt have the time to wait. Will try again.

Sorry, not gone in there yet. But thank you to everybody for their comments. Like all things Spanish, you seem to get more questions than answers. But I am not complaining, it is what makes life interesting living in this country!
It was my solicitor that told me it lasted ten years, but on the certificate it actually says it only lasts five years. Another conundrum.
We have visitors coming for half term soon, so I will probably leave it until November to go up there.
